Actions to foreclose a lien on real property are filed as a general civil case, either in Circuit Court or County Court depending upon the amount owed. Circuit Court has jurisdiction for cases exceeding $50,000 and County Court up to and including $50,000.

A foreclosure case is initiated when a lis pendens is filed. After the case goes through court, a final judgment is issued by the judge outlining the sale date, time and amount. Foreclosure sales are held online at RealAuction and administered by Real Foreclose. Specific documents in the foreclosure case are filed in the Official Records. The Clerk sells property pursuant to court order and cannot guarantee a clear title.  It is the responsibility of the purchaser to research the property prior to the sale date. The Clerk’s office is not authorized to give legal advice or assist in the research of properties.

Edna Lopez

Circuit Civil Manager

Edna has been with the Clerk’s office since 2013. She first began working as a Record Clerk in Family Relations before transferring to the Juvenile Department where she became the manager in January 2017. As the Juvenile Manager, she is responsible for managing the daily operations of the department and ensuring all state guidelines are being met. Edna has a bachelor’s degree in business administration and has taken courses towards her MBA. Edna is also an adjunct instructor at Indian River State College where she assists high school students in a college-readiness program called TRIO.
